When fiscal representation is required

Fiscal representation is generally mandatory for:

  • Residents of third countries (outside EU/EEA) who earn income subject to IRS in Portugal
  • Non-residents who do not subscribe to electronic notifications on the Tax Portal
  • Non-resident entities without a permanent establishment in Portugal
  • Situations where the law expressly requires a fiscal representative

The requirement depends on the specific framework of each case. EU/EEA citizens can, in many situations, dispense with a fiscal representative by subscribing to electronic notifications.

Available options

There are different types of entities that can act as fiscal representative:

Lawyers

Lawyers registered with the Bar Association can act as fiscal representatives. They offer deontological guarantees and professional liability insurance.

Certified Accountants

Certified accountants registered with the Order of Certified Accountants can provide this service, often together with accounting services.

Specialized companies

There are companies specialized in fiscal representation services for non-residents. Always verify their reliability and contractual conditions.

Trusted individual

Any individual with tax residence in Portugal can be appointed as fiscal representative. Common option for those with family or contacts in Portugal.

Fiscal representative responsibilities

The fiscal representative assumes before the Tax Authority the responsibility to:

  • Receive tax notifications on behalf of the represented party
  • Ensure compliance with filing obligations
  • Communicate received notifications to the represented party
  • Be jointly liable for tax payment (in certain cases)

Appointing a fiscal representative does not transfer the taxpayer's tax liability. The represented party remains responsible for fulfilling their obligations.

Reliability and experience

Verify the entity's experience in fiscal representation and their market reputation.

Contractual conditions

Carefully analyze the contract, including fees, duration, termination conditions and responsibilities.

Communication

Ensure the representative has the ability to communicate with you effectively and timely.

Liability insurance

Regulated professionals (lawyers, accountants) have mandatory professional liability insurance.
