Legal Framework

European Succession Regulation

Regulation (EU) No. 650/2012 applies to successions opened since August 17, 2015 and establishes:

  • Law applicable to succession
  • Court jurisdiction
  • Recognition of decisions
  • European Certificate of Succession

Applicable Law

General rule: Law of the State of habitual residence of the deceased

Exception: The deceased may choose the law of their nationality (professio juris)

European Certificate of Succession

What is it?

How to Obtain in Portugal

  1. Request from Notary or Registry Office
  2. Present death certificate

  • Identification of legal heirs

2. Asset Inventory

Inheritance Tax

In Portugal

Portugal abolished Inheritance Tax in 2004. Only applies:
